Sad Thought
One of the few unhappy prospects of a Hillary presidency: she would be legally precluded from making her husband Secretary of State, or indeed a Cabinet member at all, while he would be a lock for the job under any other Democratic president. And there have been few times when a country has needed a man more than America needs Bill Clinton now.

Because Republicans changed the law after Kennedy put his brother in charge of Justice.

What exactly does this law say? Is this because he is a member of her family? I wonder if it would be important enough to her to attempt to challenge the law. I would. Would having a family member as part of the cabinet inherently help or hurt that department or the administration?
He'd obviously be the biggest "unofficial" voice of a Hillary Clinton administration, so I see no issue with making it "official." He's certainly be more useful at State than planning social functions in the East Room.
